Basic Approaches to the Law and Economics in the Digitalization Age: Theoretical and Legal Search of Suitable Model of Legal Regulation

Abstract

The systematization and the author’s classification of modern key approaches that define peculiarities and nature of interaction of the law and economics and also that show suitable for the digitalization age model of state legal impact on economic relations are
presented in the article. The author defines positive and negative sides of different approaches to the law and economics interaction, of legal doctrines about forms and methods of state legal impact on economic processes in the society by means of analyzing
the phenomena within the mentioned phenomena suitability to the modern processes of the digital transformation of social interaction. The resume of the article substantiate that non of the analyzed doctrines and approaches reflect totally the complexity
of interaction and interrelation of the law and economics. At the same time the latter phenomena don’t regard the number of factors and the complex of effects on crucial changes in economic system in the digitalization age and at the time of robotization of
social technics and communications. At the same time the article asserts that the present approaches and doctrines enrich significantly the modern theory of law, and also theoretical and methodological tools of legal science by means of the classical concept of the
law and economics interrelation, from the one side. Moreover the author resumes that the number of modern approaches to the law and economics can become theoretical legal base for creating the integrative doctrinal legal base for state legal regulation of economic
relations in the digitalization age.
